1. Inleiding

deep.radio is een internetradiostation. Wij hechten waarde aan de privacy van onze luisteraars en bezoekers en gaan zorgvuldig om met informatie die wij ontvangen wanneer u onze stream beluistert of onze website bezoekt. In dit privacybeleid leggen wij uit welke gegevens wij verwerken, met welk doel en op welke wijze.

deep.radio gebruikt zelf geen accounts, registraties of profielen. Voor het leveren en meten van de dienst maken wij gebruik van twee verwerkers — Triton Digital voor de audiostream en luistermeting, en Google Analytics voor websitestatistiek — die in beperkte mate pseudonieme identifiers en technische gegevens verwerken. Wij gebruiken deze gegevens uitsluitend in geaggregeerde, niet tot individuen herleidbare vorm.

2. Verwerkingsverantwoordelijke

Voor alle vragen over dit privacybeleid en de verwerking van uw gegevens kunt u ons via dit e-mailadres bereiken. Wij reageren in beginsel binnen vier weken op uw vraag.

3. Welke gegevens verwerken wij?

3.1 Audiostream (via Triton Digital)

De audiostream van deep.radio wordt geleverd via Triton Digital. Bij het beluisteren van de stream verwerkt Triton Digital onder andere:

• IP-adres (noodzakelijk voor het routeren van het audiosignaal)
• Type apparaat, besturingssysteem en streamclient (user-agent)
• Globale locatie afgeleid van het IP-adres
• Tijdstip, duur en kwaliteit van de luistersessie
• Een door Triton gegenereerde, pseudonieme luister-identifier ten behoeve van de Webcast Metrics-meting

deep.radio ontvangt van Triton uitsluitend geaggregeerde rapportages (zoals het gemiddeld aantal gelijktijdige luisteraars, totaal aantal sessies, gemiddelde luisterduur en geografische verdeling op landniveau). Wij identificeren individuele luisteraars niet en zijn daartoe ook niet in staat op basis van de aan ons verstrekte rapportages.

3.2 Websitebezoek (via Google Analytics)

Voor het meten van het gebruik van onze website maken wij gebruik van Google Analytics 4. Hierbij worden onder andere de volgende gegevens verwerkt:

• Een pseudoniem identificatienummer (Client ID), opgeslagen in een cookie of vergelijkbare techniek
• IP-adres (door Google ingekort/gemaskeerd voordat het wordt opgeslagen)
• Type apparaat, besturingssysteem en browser
• Bezochte pagina’s, klikgedrag en duur van het bezoek
• Globale locatie op stad-/landniveau
• De pagina via welke u op onze site terechtkwam (referrer)

Wij hebben Google Analytics ingericht conform de aanwijzingen van de Autoriteit Persoonsgegevens, waaronder:

• een verwerkersovereenkomst met Google;
• maskering van het laatste octet van IP-adressen;
• uitschakeling van het delen van gegevens met andere Google-diensten en advertentiefuncties;
• een zo kort mogelijke bewaartermijn op de gegevens.

3.3 Mobiele apps (Android en iOS)

deep.radio is ook beschikbaar als mobiele app, gedistribueerd via de Google Play Store (Android) en de Apple App Store (iOS). Bij gebruik van de apps worden in aanvulling op het bovenstaande de volgende gegevens verwerkt:

• Een door het besturingssysteem verstrekte, pseudonieme app-identifier (zoals een resetbare advertising ID of een app-instance-ID), uitsluitend voor geaggregeerde gebruiksstatistieken en crashrapportage.
• Technische gegevens over het apparaat: model, besturingssysteem en versie, taalinstelling en netwerktype.
• Crash- en prestatiegegevens, om storingen op te sporen en de stabiliteit van de app te bewaken.

De stream zelf wordt binnen de apps geleverd via de Triton Digital SDK; de in §3.1 beschreven verwerking is daarop van overeenkomstige toepassing.

De apps plaatsen geen cookies. Voor het onthouden van uw voorkeuren wordt gebruikgemaakt van lokale opslag binnen de app op uw eigen apparaat. De apps tonen geen advertenties en voeren geen cross-app tracking uit; op iOS zal daarom ook geen App Tracking Transparency-prompt verschijnen.

4. Doel en rechtsgrond

Wij verwerken bovenstaande gegevens voor de volgende doeleinden:

• Operationeel beheer: het technisch leveren van de audiostream, het bewaken van de beschikbaarheid en het oplossen van storingen.
• Statistiek: het opstellen van geaggregeerde luistercijfers, zoals het aantal gelijktijdige luisteraars, populaire luistertijdstippen en geografische verdeling op landniveau.
• Beveiliging: het detecteren en afweren van misbruik, zoals overbelasting van de stream of geautomatiseerde aanvallen.

Voor zover bij deze verwerkingen kortstondig persoonsgegevens (zoals IP-adressen) worden gebruikt, baseren wij ons op het gerechtvaardigd belang (artikel 6 lid 1 sub f AVG) van deep.radio bij een goed werkende, veilige en gemonitorde dienst. Geanonimiseerde en geaggregeerde gegevens vallen niet onder de AVG.

5. Bewaartermijnen

• Verbindingsgegevens van de audiostream (IP-adres, sessieduur): worden door Triton Digital verwerkt voor zover noodzakelijk voor het leveren van de stream en de luistermeting. deep.radio ontvangt zelf alleen geaggregeerde rapportages.
• Google Analytics-gegevens: maximaal 14 maanden op gebruikers- en gebeurtenisniveau; geaggregeerde rapportages kunnen langer bewaard blijven.
• Geaggregeerde, niet herleidbare statistieken: kunnen onbeperkt worden bewaard.
• Loggegevens van onze eigen website ten behoeve van beveiliging en foutopsporing: maximaal 30 dagen, waarna deze automatisch worden verwijderd of geanonimiseerd.

6. Cookies en vergelijkbare technieken

deep.radio gebruikt de volgende soorten cookies:

• Functionele cookies en vergelijkbare technieken, die noodzakelijk zijn voor het goed functioneren van de website en de streamspeler (zoals het onthouden van uw volume- of streamkeuze).
• Analytische cookies via Google Analytics, om geaggregeerd inzicht te krijgen in het gebruik van onze website. Deze cookies hebben dankzij de hierboven beschreven configuratie geen of slechts een geringe impact op uw privacy.

Wij plaatsen geen tracking- of advertentiecookies en gebruiken Google Analytics niet voor profilering, hertargeting of advertentiedoeleinden.

U kunt cookies altijd verwijderen of blokkeren via de instellingen van uw browser. Het uitschakelen van functionele cookies kan ertoe leiden dat onderdelen van de site of de streamspeler niet meer naar behoren werken.

7. Verwerkers en delen met derden

Voor het leveren van onze dienst maken wij gebruik van de volgende verwerkers:

• Triton Digital (Triton Digital Canada Inc., Canada, met inzet van infrastructuur in onder meer de Verenigde Staten en de Europese Unie) — voor het leveren van de audiostream en het uitvoeren van luistermetingen (Webcast Metrics).
• Google Ireland Limited (Ierland, met Google LLC in de Verenigde Staten als sub-verwerker) — voor websitestatistiek via Google Analytics 4.

De hosting van onze website en infrastructuur wordt verzorgd binnen Deep Media zelf en betreft daarom geen verwerking door een derde partij.

Met al onze verwerkers zijn verwerkersovereenkomsten gesloten, waarin afspraken zijn gemaakt over de vertrouwelijkheid en beveiliging van gegevens. Wij verkopen of verhuren geen gegevens aan derden en gebruiken gegevens niet voor profilering of advertenties.

Distributieplatforms voor onze apps

Onze mobiele apps worden gedistribueerd via:

• Apple Inc. (Verenigde Staten) — via de Apple App Store, voor de iOS-app.
• Google Ireland Limited / Google LLC (Ierland en Verenigde Staten) — via de Google Play Store, voor de Android-app.

Apple en Google verwerken als zelfstandige verwerkingsverantwoordelijken bepaalde gegevens over installaties, updates, in-app aankopen en (geaggregeerde) gebruiksstatistieken van onze apps. Op deze verwerkingen is het privacybeleid van Apple respectievelijk Google van toepassing. deep.radio ontvangt van deze platforms uitsluitend geaggregeerde rapportages.

Doorgifte buiten de EER

Een deel van de gegevens kan worden verwerkt op servers buiten de Europese Economische Ruimte (EER), met name in de Verenigde Staten. Voor deze doorgifte baseren wij ons op:

• het EU-US Data Privacy Framework, voor zover de betreffende verwerker daarbij is aangesloten (Google LLC is gecertificeerd onder dit kader); en/of
• de modelcontractbepalingen (Standard Contractual Clauses) van de Europese Commissie, aangevuld met passende technische en organisatorische maatregelen.

8. Beveiliging

deep.radio neemt passende technische en organisatorische maatregelen om misbruik, verlies, onbevoegde toegang en ongewenste openbaarmaking tegen te gaan. Hieronder vallen onder andere versleutelde verbindingen (TLS), toegangscontrole op systemen en regelmatige beveiligingsupdates.

9. Uw rechten

Omdat wij geen tot individuen herleidbare gegevens vastleggen, kunnen wij verzoeken op grond van de AVG (zoals inzage, correctie of verwijdering) doorgaans niet aan een specifiek persoon koppelen. Heeft u toch vragen over uw privacy of over deze verklaring, neem dan contact met ons op via de gegevens onderaan dit document. Wij doen ons best om uw vraag binnen een redelijke termijn te beantwoorden.

U heeft daarnaast het recht een klacht in te dienen bij de Autoriteit Persoonsgegevens (autoriteitpersoonsgegevens.nl).

10. Wijzigingen

deep.radio kan dit privacybeleid van tijd tot tijd aanpassen, bijvoorbeeld bij wijzigingen in onze dienstverlening of in de geldende wet- en regelgeving. De meest actuele versie is altijd via onze website beschikbaar. Bij ingrijpende wijzigingen zullen wij dit op een passende manier kenbaar maken.

1. Introduction

deep.radio is an internet radio station. We value the privacy of our listeners and visitors and handle information we receive when you listen to our stream or visit our website with care. In this privacy policy, we explain what data we process, for what purpose, and in what manner.

deep.radio itself does not use accounts, registrations, or profiles. To deliver and measure the service, we make use of two processors — Triton Digital for the audio stream and listener measurement, and Google Analytics for website statistics — which process pseudonymous identifiers and technical data to a limited extent. We use this data exclusively in aggregated form that cannot be traced back to individuals.

deep.radio is a trade name of Deep Media.

3. What data do we process?

3.1 Audio stream (via Triton Digital)

The audio stream of deep.radio is delivered via Triton Digital. When listening to the stream, Triton Digital processes, among other things:

• IP address (necessary for routing the audio signal)
• Device type, operating system, and stream client (user-agent)
• Global location derived from the IP address
• Time, duration, and quality of the listening session
• A pseudonymous listener identifier generated by Triton for the purposes of Webcast Metrics measurement

deep.radio receives only aggregated reports from Triton (such as the average number of concurrent listeners, total number of sessions, average listening duration, and geographical distribution at country level). We do not identify individual listeners and are not able to do so based on the reports provided to us.

3.2 Website visits (via Google Analytics)

To measure the use of our website, we make use of Google Analytics 4. The following data is processed, among other things:

• A pseudonymous identification number (Client ID), stored in a cookie or similar technology
• IP address (shortened/masked by Google before being stored)
• Device type, operating system, and browser
• Pages visited, click behaviour, and duration of the visit
• Global location at city/country level
• The page through which you arrived at our site (referrer)

We have configured Google Analytics in accordance with the instructions of the Dutch Data Protection Authority (Autoriteit Persoonsgegevens), including:

• a data processing agreement with Google;
• masking of the last octet of IP addresses;
• disabling the sharing of data with other Google services and advertising functions;
• the shortest possible retention period for the data.

3.3 Mobile apps (Android and iOS)

deep.radio is also available as a mobile app, distributed via the Google Play Store (Android) and the Apple App Store (iOS). When using the apps, the following data is processed in addition to the above:

• A pseudonymous app identifier provided by the operating system (such as a resettable advertising ID or an app instance ID), used exclusively for aggregated usage statistics and crash reporting.
• Technical data about the device: model, operating system and version, language settings, and network type.
• Crash and performance data, to detect malfunctions and monitor the stability of the app.

The stream itself is delivered within the apps via the Triton Digital SDK; the processing described in §3.1 applies accordingly.

The apps do not place cookies. To remember your preferences, local storage on your own device within the app is used. The apps do not display advertisements and do not perform cross-app tracking; therefore, on iOS no App Tracking Transparency prompt will appear.

4. Purpose and legal basis

We process the above data for the following purposes:

• Operational management: the technical delivery of the audio stream, monitoring availability, and resolving malfunctions.
• Statistics: compiling aggregated listener figures, such as the number of concurrent listeners, popular listening times, and geographical distribution at country level.
• Security: detecting and warding off misuse, such as overloading of the stream or automated attacks.

To the extent that personal data (such as IP addresses) are briefly used in these processing activities, we base ourselves on the legitimate interest (Article 6(1)(f) GDPR) of deep.radio in a properly functioning, secure, and monitored service. Anonymised and aggregated data does not fall within the scope of the GDPR.

5. Retention periods

• Connection data of the audio stream (IP address, session duration): processed by Triton Digital for as long as is necessary for delivering the stream and the listener measurement. deep.radio itself only receives aggregated reports.
• Google Analytics data: maximum 14 months at user and event level; aggregated reports may be retained longer.
• Aggregated, non-traceable statistics: may be retained indefinitely.
• Log data of our own website for security and error detection purposes: maximum 30 days, after which it is automatically deleted or anonymised.

6. Cookies and similar techniques

deep.radio uses the following types of cookies:

• Functional cookies and similar techniques, which are necessary for the proper functioning of the website and the stream player (such as remembering your volume or stream choice).
• Analytical cookies via Google Analytics, to obtain aggregated insight into the use of our website. Thanks to the configuration described above, these cookies have no or only a minor impact on your privacy.

We do not place tracking or advertising cookies and do not use Google Analytics for profiling, retargeting, or advertising purposes.

You can always delete or block cookies via the settings of your browser. Disabling functional cookies may result in parts of the site or the stream player no longer functioning properly.

7. Processors and sharing with third parties

For the delivery of our service, we make use of the following processors:

• Triton Digital (Triton Digital Canada Inc., Canada, using infrastructure in, among others, the United States and the European Union) — for delivering the audio stream and performing listener measurements (Webcast Metrics).
• Google Ireland Limited (Ireland, with Google LLC in the United States as a sub-processor) — for website statistics via Google Analytics 4.

The hosting of our website and infrastructure is provided within Deep Media itself and therefore does not concern processing by a third party.

We have concluded data processing agreements with all of our processors, in which arrangements have been made regarding the confidentiality and security of data. We do not sell or rent data to third parties and do not use data for profiling or advertising.

Distribution platforms for our apps

Our mobile apps are distributed via:

• Apple Inc. (United States) — via the Apple App Store, for the iOS app.
• Google Ireland Limited / Google LLC (Ireland and United States) — via the Google Play Store, for the Android app.

Apple and Google process certain data as independent data controllers regarding installations, updates, in-app purchases, and (aggregated) usage statistics of our apps. The privacy policy of Apple and Google respectively applies to this processing. deep.radio receives only aggregated reports from these platforms.

Transfer outside the EEA

Part of the data may be processed on servers outside the European Economic Area (EEA), in particular in the United States. For this transfer, we base ourselves on:

• the EU-US Data Privacy Framework, insofar as the relevant processor is affiliated with it (Google LLC is certified under this framework); and/or
• the Standard Contractual Clauses of the European Commission, supplemented with appropriate technical and organisational measures.

8. Security

deep.radio takes appropriate technical and organisational measures to prevent misuse, loss, unauthorised access, and unwanted disclosure. These include encrypted connections (TLS), access control on systems, and regular security updates.

9. Your rights

Because we do not record data that can be traced back to individuals, we are generally unable to link requests under the GDPR (such as access, correction, or deletion) to a specific person. If you nevertheless have questions about your privacy or about this statement, please contact us using the details at the bottom of this document. We will do our best to answer your question within a reasonable period of time.

You also have the right to lodge a complaint with the Dutch Data Protection Authority (autoriteitpersoonsgegevens.nl).

10. Changes

deep.radio may amend this privacy policy from time to time, for example in the event of changes to our service or to applicable laws and regulations. The most recent version is always available via our website. In the event of significant changes, we will announce this in an appropriate manner.
